My family moved out on 12/31/2009 and the owner told us they will sent us our deposit. It's been two weeks and nothing. I called them many times and left them massages but no respond. What can I do in this situation??? Please help thx...|||Understand that many states allow up to 45 days for return of such deposits. You need to check your state's statutes to determine whether or not your past landlord has not followed the laws of your state. I know of NO states which require a deposit return in two weeks.|||Acermill is correct. Some states even allow up to 60 days to return a deposit, although the average is 30. Without knowing your state, I can't say the exact time limit for your state, but only 7 states say it has to be returned that quickly (2 weeks).
You did give the LL your forwarding address in writing, I hope? Some states say if you don't, the LL has no obligation to return it. If you didn't, send it to him now.
Wait at least 30 days. If the LL hasn't returned it by them, send a demand letter asking for the deposit. Mail it certified mail, return receipt requested, and keep a copy. If he doesn't respond, file against him in small claims court to get the money back. If you have to go that far to get it, ask for the penalties that you could be entitled to. (Some states allow 2-3x the deposit as a penalty for wrongful withholding.) In the meantime, quit calling the LL. Calling him over and over when he hasn't reached the deadline yet will get you no where. Be patient.
